Terms and Conditions

1. Acceptance of these terms

These Terms and Conditions govern your access to and use of HillsMart, including its website, customer accounts, supplier portal, bulk-order services, product listings, orders, reviews, and support services. By creating an account, submitting information, placing an order, or using the platform, you agree to these terms and our Privacy Policy.

If you do not agree, please do not use HillsMart. You must be at least 18 years old or use the platform under the supervision of a parent or lawful guardian.

2. Accounts and security

You must provide accurate, current information and keep your username, password, email address, and mobile number secure. Activities performed through your account will be treated as authorised by you unless you notify HillsMart promptly of suspected misuse.

We may suspend or close accounts that contain false information, misuse the platform, violate law, threaten safety, or breach these terms. Passwords are not available for viewing; approved reset processes must be used.

3. Marketplace and product information

HillsMart connects customers and bulk buyers with artisans, farmers, self-help groups, traders, and other suppliers. Product photographs, videos, stories, origin, ingredients, dimensions, stock, seasonality, shelf life, FSSAI information, and delivery estimates are provided for informed purchasing. Natural, handmade, and agricultural products may reasonably vary in colour, size, texture, weight, or appearance.

Supplier products require administrative approval before public sale. Approval is a platform control and does not replace any legal certification, warranty, or independent inspection required for a particular product.

4. Prices, orders, payments, and delivery

Prices are shown in Indian rupees unless stated otherwise. Stock, price, taxes, delivery charges, and availability are confirmed when an order is processed. Placing an order is an offer to buy; HillsMart may accept, reject, or cancel it where stock is unavailable, information is incorrect, payment is not confirmed, delivery is impracticable, or fraud is suspected.

Available payment methods may include UPI or manual confirmation, bank transfer, and cash on delivery. Do not send money to an account or link that is not confirmed through HillsMart’s official contact channel. Ownership and risk pass as permitted by applicable law and the agreed delivery terms.

Delivery dates are estimates. Fresh and perishable products remain subject to harvest, quality, weather, route, and city availability. Customers must provide a complete address and be available to receive delivery.

5. Supplier responsibilities

Suppliers must provide truthful identity, contact, origin, stock, pricing, bank, pickup, product, and compliance details. Suppliers are responsible for product quality, lawful sourcing, packaging, labelling, applicable GST, FSSAI or other licences, and the accuracy of uploaded photographs, videos, and social links.

Submitting a product does not make it available for sale. HillsMart may approve, reject, unpublish, request corrections to, or remove any product. Suppliers must fulfil accepted orders, update stock promptly, provide genuine courier or transportation details, and cooperate with complaints, returns, refunds, and regulatory enquiries.

6. Bulk enquiries and quotations

A bulk enquiry is not a confirmed order. Quantity, minimum order value, price, tax, packaging, transport, delivery schedule, payment terms, validity, recurring supply, and product grade must be agreed in a quotation or written confirmation. Negotiated B2B terms prevail for that transaction where they differ from general retail terms.

7. Cancellations, returns, and refunds

Eligibility depends on the product, condition, reason, delivery status, and applicable law. Perishable, personalised, made-to-order, opened food, hygiene-sensitive, and damaged-after-delivery products may not be returnable unless defective, incorrectly supplied, unsafe, or otherwise returnable by law.

Report missing, damaged, incorrect, or defective goods promptly through HillsMart support with the order number and clear evidence. Approved refunds are returned through an available method after verification and may take time to appear depending on the payment provider or bank.

8. Reviews, content, and acceptable use

You retain responsibility for content you submit and grant HillsMart permission to host, display, reproduce, and use it for operating and promoting the marketplace. Reviews must reflect genuine experience. You must not upload unlawful, misleading, infringing, abusive, unsafe, malicious, or fraudulent content; scrape the service; interfere with security; impersonate another person; or use the platform for prohibited trade.

HillsMart names, logos, site design, and original platform content may not be copied or commercially used without written permission.

9. Disclaimers and limitation of liability

HillsMart aims to keep information and services accurate and available, but uninterrupted operation, exact delivery times, continuous stock, or error-free third-party services cannot be guaranteed. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

To the extent permitted by law, HillsMart is not liable for indirect, incidental, special, or consequential loss arising from platform use, third-party services, supplier misconduct, delivery disruption, or events beyond reasonable control. Any liability will be limited to the amount paid for the affected order, except where applicable law requires otherwise.

10. Changes and termination

We may update the platform and these terms to reflect operational, legal, security, or service changes. The revised effective date will be shown here. Continued use after an update means acceptance of the revised terms. Provisions intended to survive account closure will continue to apply.

11. Governing law and contact

These terms are governed by the laws of India. Subject to applicable consumer rights and mandatory jurisdiction rules, disputes will be subject to the courts having jurisdiction in Itanagar, Arunachal Pradesh. Parties should first attempt good-faith resolution through HillsMart support.
